Suspect and victim say fatal shooting was accident

COLUMBUS, Ohio – A man claims a fatal shooting in a Galloway home was an accident and the victim backed up his story, police say.

The man, whose name has not been release by police, says he and the victim, John Fisk, were at the home of a mutual friend on Westedge Court shortly after 2:30 a.m. Wednesday after an evening of drinking at a local bar, homicide detectives said.  As the three men were “handling” some firearms when the suspect pulled the trigger on an M-1 Garand Rifle, unaware that the gun was loaded, police said.

The rifle discharged and the bullet struck Fisk in the upper arm. He was transported to Mt. Carmel West Hospital where he died about three hours later, police said.

Investigators say, before he died, Fisk told officers and medical personnel that the shooting was an accident.

The suspect was not charged and detectives say the investigation will be forwarded to the Franklin County Prosecutors Office for review and presentation to the Franklin County Grand Jury.
